  • I-485 Application with I-864

    Good afternoon, everyone

I'm glad that i find this helpful forum. I'm ready to submit the greencard application for my wife with concurrently filling I-130 and I-485. My wife currently has F-1 student visa and reside in the US with me. Do I still need to fill out the form I-864 and submit it with I-485? Any inforamtion will be appreciated. Thank you.

I-130 / I-130A --> This is USC's petition for foreign spouse (has filing fee) (REQUIRED - spouse CANNOT file marriage-based I-485 w/o this)

I-485 --> This is foreign spouse's application to adjust status (has filing fee)
I-864 --> This is the USC's promise to support foreign spouse (REQUIRED)

I-131 --> This is the travel document (no filing fee) (must have pending I-485)

I-765 --> This is the work authorization (no filing fee) (must have pending I-485)

Concurrent filing allows you to submit all of these together as one packet.
You should submit all the forms, along with all the evidence required for each form, and the two filing fees in separate checks.

Although you do not have to file the I-765 or the I-131, you should. They are free and allow work and travel. You may apply for travel authorization even without set plans.

The instructions are on uscis.gov as well.
