Good afternoon, I arrived in the United States in 2001, I applied for asylum and they denied me, I have a removal order, I appealed in 2003 and the appellate court indicated the same. I am a lawyer in my country and met a wonderful American citizen in December 2016, we got married and presented the I-130, I-485 papers and all the necessary formats. Yesterday we had the interview and the officer was very cordial and professional, he told us that he was going to approve I-130 because our marriage was true, I take many documents in copy, photos, bank statements, 401K that I am a beneficiary, but He could not approve I-485 for the removal order. That I should do another process for that. Can you share your suggestions please? Thank you very much.

I-212
With a removal order on records, you need to file either the form I-212 or ask the court to remove the Removal order. It?s a complicated process. Not every attorney knows how to navigate this. There are a few members of this forum who were successful and granted green cards by filing concurrently i130/i485/i 212.

First let me say, it was very risky going to this interview without an attorney. Unless you have some other kind of protection, married to a US citizen does not protect you from deportation if you have a removal order.
Hire a good attorney with experience in removal proceedings. Act like you don?t know about the form I 212 to see if the attorney will bring that up as an option. If he or she makes no mention of form i212, they probably have no experience in this area. Interview another attorney.
When the i212 is filed, it could take months to get approved. Once it?s approved, take it back to the officer who interviewed you and likely they will approve your i485.
