  • Married!! Now what? Please help.

    Quick background - I am a Peruvian citizen in the USA on a K1 Visa. My husband (US citizen) and I just got married on Feb 7th but are not sure what steps we need to do next. Please help!

    1. What are the first steps to getting a green card and permission to work in the US? Is there a helpful checklist to follow?
    2. Is it worth hiring a lawyer for this process? Or is it possible to do it ourselves?
    3. What is the approximate cost for the application fees?
    4. What us the approximate timeframe for both the Green card as well as permission to work.

    Hey! You have to concurrent file a i-485, i-130 and i-765. Go to the USCIS website. The forms are there and you just have to print it and check the fees and pass the documents that are needed.

    PD ? 10/01/2018
    Biometrics NOA: 10/10/18
    Biometrics Appt: 10/30/2018
    02/5/2019: I/693 courtesy letter received
    I-485 ? 02/11/2019 CASE IS READY FOR INTERVIEW

      Thank you for the reply and information. Question though, Does the "Adjustment of Status" need to be submitted first before applying for a Green Card, or is it part of the green card process? Thanks, again.

      Also, how can I work in the US while I apply and wait for the green card?

        You sound way too confused to do it yourself. Hire a lawyer.

          1.- there are several posts in the forum with information.
          2.- lawyer prices varies a lot, a good lawyer with experience may be worth it. Yes it is possible to do it by yourself, but you have to read a lot, download the forms, read a lot of instructions (there is a lot of information here in the forum and other sites)
          3.- More than $2,000 for forms and medical exam
          4.- permission to work (form I-765) around 6 months, green card, it depends where you live, it could be anywhere from 8 months up to 30 months. Very rare cases in 3 months (from what I've seen in the forums).

            Assuming the OP married within 90 days of entry on K1, they should NOT file I-130. Their I-485 would be based on having married within 90 days of entry on K1. Only if they married after the 90 days would they file I-130.

            Adjustment of Status is the process of getting a green card from inside the US.
