  • Adjusting status on esta

    Hi everybody,

i've got married in overseas recently. My husband is an American citizen. We have been living together in Europe for 4 years and have a 2 year old child together (Who is also an American citizen).
We entered in the usa 2 weeks ago using my "esta/vwp" intending to stay for a visit 30 days. Now, my husband got a job offer from his dad and wants to stay here and propose me the adjustment of status.
Should I have to wait expire 90 days to send the papers? I say that because of the new rules of 90 days.
Will there be any complications? Is there anybody who got success on it ?

    Any advice appreciated.

If you are already married, have a 2 year old child together and can prove that you have lived together for 4 years (plus dating), I don't see any problems for you.

The 90 day rule is for people that enter the USA as a visitor, get married and file the papers. I don't think that applies to you (already living together/married with a child), so you enter the USA legally with your husband and child.
