  • NY DMV wont renew Drivers License based on EAD extension letter

    Just letting you know my experience. DMV wont accept the 180 extension receipt letter, and need the new card to extend TEMP VISTOR expiry

    Been advised not to drive till I get it. Wonderful!

    Anyone got a workaround I'm listening...

    Hey,
    I went to a dmv in brooklyn and I ask them about it and they say all I need is to fill out a paper (which he handed me) and bring the extension. I haven?t gone back as yet to get it done tho. But it seems like that was the process, and that I pay $12 to get a new card.

      I went to Brooklyn yesterday and was told no, and when he checked with the supervisor they said no. Its the usual, no actual process, luck of the draw

        Can you try a different location?

        In Illinois, my wife experienced one DMV location which insisted on the Green Card. But a different location accepted the EAD. The same location also accepted the 180 day extension letter from the renewal.

            Interesting, NYC has the reputation of providing a drivers license to illegals (no idea if it's true, but that's their rep in other states), but now they won't renew based on EAD extension letter.
            Employment-based AOS (I-140, I-485, I-131, I-765)
            08-24-18: Case was Received
            10-10-18: Biometrics appointment
            10-11-18: I-131 and I-765 approved
            10-18-18: Combo Card in hand
            01-31-19: I-140 approved
            05-09-19: Ready for an Interview
            05-13-19: Interview is Scheduled
            06-24-19: Interview
            06-28-19: Received Green Card

              i'm not sure why that would be a representation but this is absolutely not true about NY in any. UNDOCUMENTED immigrants are not given anything the law doesn't allow them to get in the state of New York. There are other states however who will give an undocumented immigrant their drivers license because the law allows it. Just like in many other institutions not everyone is aware of all the rules and regulations some may be new and others just have never had to deal with an EAD extension letter. Its in that moment that you ask for a higher up or go to another DMV and try there.

                Try Coney Island DMV, that?s where I went and they gave me the information.

                  Thanks I will. Staten Island "raised a case" to confirm my immigration status. We will see what happens

                    Same story. I have a 180 days extension letter. I went to coney island dmv,where i been told plastic(work authorization) only. Then i went to staten island dmv, where after SAVE check ,they said that they provide me anything. Couple of weeks later i been to Queens and i decided to check if they can help. AND... THEY GAVE ME NEW DRIVER LICENSE WITHOUT A SINGLE QUESTION( I passed the line and went straight to supervisor)

                      Same story happened to me. My EAD card ended in November , few days before i send i-765 for one more year. When i went to Coney island DMV to extend my Driver License,i been told to go to local uscis office and bring new papers, then in USCIS office ,they told me over the phone, that i need to bring a letter from DMV...(basically they said no ID for me).
                      A few days later i drove to Staten Island DMV, where after SAVE check and 1 week of waiting time,they also denied me.
                      A Month later i been to Queens for my own stuff and i passed Jamaica DMV, on the way back i went inside,where THEY GAVE ME DRIVER LICENSE WITHOUT A SINGLE QUESTION(i spoke directly to supervisor)

                        Your comments are helpful to me. Thanks much. I'm just sharing my experience in case if anyone has any trouble in terms of getting a driver's license through the I485/ Adjust pending receipt notice.

                        I have been in the united states for almost 10 years and recently got married and filed an adjustment of status. I have received the I485 pending receipt notice from USCIS. I went to DMV Jamaica to check my luck and found out that I could get a License with the I485 pending receipt notice. Initially, I thought I would receive the driver's license only with the help of I485 approval notice or approved employment authorization. Later after having a thorough conversation with the DMV official. It's not only in Jamaica but these rules are followed by the entire NY state. All you have to do is to prove that you entered into the United States legally and collect as many proofs as you can to match with their point system.

                        Below proofs, I carried to DMV

                        The total no. of points to get is 6 If you're looking regular Driver's license not the enhanced ID one

                        Proof of Name/ Proof of address: Bank statement Debit/Credit - 1 point ** point
                        DOB: Previous License 4 points --You can share either passport or Driver's license - Mine was expired on OCT 2020. Waited until I get I485 pending receipt notice
                        Foreign passport - To show it as the proof of Name / DOB -- 4 points (They usually check passport whether you entered legally. I showed mine as I entered legally and H1B was expired on OCT 2020)
                        I485 Pending receipt notice -- They verified my name and told me that once I get a green card I'm eligible to apply for Enhanced/Real ID(Driver's license) but for now they said I could get a Regular driver's license based on pending receipt notice. As long as I'm driving that's all matters
                        Marriage certificate - 2 points They verified my name

                        Based on my experience they always tell you to collect as many proofs as you can to you're a real person with Identity.

                          wow this is enlightning! the dmv in chicago never asked me for any of that when i needed to get a license (i used my aussie one for 3yrs). They just wanted proof of where i lived and some I.D that was all.

                            Starting December 2019, you can get a Standard (i.e. non-REAL-ID) driver's license in New York regardless of immigration status. You don't need to show that you are in the US legally.

                              Somehow New Jersey DMV is parallel immigration authority where they don’t consider AOS Receipts and only renew when you show EAD card. Anyone able to renew license in NJ based on AOS receipts?
