AOS and Marriage

Hello Folks,

I am working in US on H1B. I-485 pending with CSC since March 2002. I am planning to get married soon.

1) How much time should it take for getting H4?

2) When I file the dependent GC for my spouse does she get the same priority date? If not what would be her status when I get my GC?

H4 is immediate

So long as your H1B is valid and your 485 is pending your spouse can get her H4 immidiately.

Have your spouse carry your H1B notice,Employment letter, Marriage Certificate and Photo Album for her H4 interview at the consulate.

She can travel to the US on an H4 and you can file for an derivative adjustment for her so long as your application is pending

Generally BCIS will try and add your spouse's file to your file i.e. both of you get ur gc on the same date - but that depends on the processing center and the dates when you and your spouse has filed for 485.
