  • Your case is being held for review. Please allow 120 days. Who else went throug this?

    Hello All,

I went for an interview at the Oakland Park, FL office January 28th. The interview went fine but at the end I received a letter stating that my case was under review and to allow 120 days before making an inquiry with them. Not even my Online status has changed, it still says my Interview was scheduled, not even sure if this it normal!!

I wanted to know who else went through this? Please share your experience here!!

When did you have your interview?
How long after the interview and receiving this letter did you receive your green card or any notice?
What office did you get your interview done?
Did you take any action? Infopass, lawyer, senator? Did it work?
Anything else you want to share?

I wanted to get from this a average of how long it usually takes!! and hoping to help not just me but other people in similar situation

    UPDATE!! 3/27/19

60 days after or green card interview, they mailed my wife's Renewed Work Permit yesterday which the extension had expired last month..
No updates on I-130 or I-485

    Go figure!!!

I went for my interview on 2/26 in Atlanta, GA. Got an RFE, so your situation is slightly better than mine, I wouldn't worry too much. I'm sure your green card will come in a month or two the latest!
    PD - 3/2/2018
    Biometrics - sometime in April
    RFIE - 7/3
Response to RFE received - 7/16

I don't have personal experience but I have read a few posts from people that got the 120 day letter. I think all received the approval at around 2 months, if no RFE. If they received RFE, then the approval was a couple of weeks after sending back whatever they requested.

Good luck, I hope you get it this month.
Nov 2018 - Package sent - EB - Texas Service Center
Day 1 - Package received at the lockbox

I don't know what is worse haha.. I heard if you get an RFE your case is in movement and from what I hear once they receive whatever it is they asked you get approved in a few days/weeks.

My case I don't have any info whatsoever, nothing even changed on the online status, so we are in complete darkness!!

            Hello Iggor,

The interview was about 30 minutes, we took a translator for my wife and everything went fine, the office was polite and calm asked us basic questions, did not separate us, the only thing I though it was weird is that she did not keep any photos that we took, only documents. She forgot to ask for the new medicals so I gave it to her at the end of the interview and also, she forgot to give my wife her passport back so we returned the next day to pick it up. She never displayed any doubt about our marriage which is real anyway but then at the end we she told me her supervisor has to check everything and we got a latter for those 120 days.

Other than that, it went fine.

Please don't forget to post your experience as well once you get yours done, and good luck to you.

BTW, I sent you a private message, check it out!!

BTW2 - Our field Office, starting March 18 will stop to do Walk in and InfoPass!! Not sure if this is good or bad news!!

We got the same thing in the Baltimore field office. Interview was on 11/5/2018, so far no response as of 3/14/2019.
We are EB1 - MX, so we are not current at this moment. Lawyers say it's not worth it to inquire after 120 days because we are not current anyway. I ignored them and called the service center, and they've put an inquiry with the Baltimore field office, gave me a T1F....TSC tracking number (which doesnt work anywhere online...) and said we'd hear from them in 30 days. My guess is that we'll hear "you are not current" but who knows.

What does that mean? We are not current? How do you check that?

On my I-485 and I-130 original receipt there is a priority date of April 27th 2017. My interview letter that I received back in December the Priority date is blank.

So, help me out to understand this!!

You check your approved form (I-130, I-140), I-130 for you, then go see the visa bulletin and check the Final Action Date (I-130 Family, I-140 Employment). Then you see the table, check the category row and the country column (born country). If your PD date (the date they received your approved form) is older than the Final Action Date for your type, category, country then there are GC available for you, if not, then you have to wait.

USCIS, in coordination with Department of State (DOS), is revising the procedures for determining visa availability for applicants waiting to file for employment-based or family-sponsored preference adjustment of status. The revised process will better align with procedures DOS uses for foreign nationals who seek to become U.S. permanent residents by applying for immigrant visas at U.S. consulates and embassies abroad.

Example, for Employment Based, 1st preference, Mexico, the current date is everyone with PD up to Dec 31, 2017 (older than 01JAN18 from the bulletin). In this case is better to be not that qualified because for Mexico 2nd/3rd preference are C (all PD dates), but if you see India 1st is 22FEB17 and 2nd 09APR09, a big gap.

                      At 2 months already...

My interview was Jan. 9 2019 in Newark NJ Field office. Did not receive any white paper but maybe lawyer did, anyway Officer told us they will just give us a RFE if they need any documents so just wait 120 days. Case changed to Interview Completed and Case Must Be Reviewed on Jan. 13. Its been 2 months and no update yet. Anybody out there whose at 2 months or more under review?
