  • Concurrent Filing of I-130 and I-485

    Hello, I am a U.S citizen that lived in the Philippines from birth.
    A little background on the situation.
    My mother is married to my deceased U.S citizen father.
    Papers weren't processed soon enough that is why I'm the one continuing it.
    I only went to the US, 2 times and one of which includes this instance while I am writing this.
    I am concurrently filing for my mother who is also here in the US with me.
    She is on B1/B2 Visa valid for 10 years, as long as she stays here for only 6 months each time.
    Since I'm of age and we can petition her, she opts to stay in the US for more than 6 months.
    She lapsed a month already.

    I am still studying in the Philippines, supported by a Trust Fund from my deceased father.
    Thus, a good friend of my mother would help us by being a second petitioner (I-864).
    Can somebody please confirm my list of documents and supporting documents?
    Please let me know if I am missing anything. Thanks in advance.

    1. G-1145 E-notification of application/petition acceptance,

    2. I-130 (Petition for Alien Relative),

    US Birth certificate showing the name of both parents
    US Passport
    2 Passport Photo
    Copy of my parents' marriage certificate
    Copy of my fathers' death certificate

    3. I-485 (Application to Register Permanent Residence or Adjust Status),

    Copy of Beneficiary current Passport
    A copy of her VISA from her old passport
    All pages showing stamps of her entrance and exit from the US (She traveled more than 5x)
    Birth Certificate of the Beneficiary and the Petitioner
    Copy of my parents' marriage certificate
    Copy of my fathers' death certificate
    2 Passport Photo


    4. I-864 (Affidavit of Support Under Section 213A of the INA), - First Petitioner (Myself)

    A letter of explanation why I did not file taxes
    A letter of explanation that I have plans of residing in the US after I finish my degree in the Philippines
    Notarized documents stating that I own the house and trust fund my father left - the reason why I will reside here in 2 years.
    Proof of my studies in the Philippines (ID, tuition receipts)
    Bank statements of accounts opened in US

    5. I-864 (Affidavit of Support Under Section 213A of the INA), - Second Petitioner (My mother's friend)

    US Passport
    Copy of Individual Tax Return for 2018 and 2017
    The 2017 copy was filed jointly with ex-husband, so she gave W-2 for years 2016-2018


    6. I-765 (Work)

    Since I am filing concurrently, what exactly should I put?
    (c)(7) - Nonimmigrant
    (c)(9) - Adjustment of status applicant?
    1 Passport Photo
