  • A little dilemma after the Interview

    Hello.
Hopefully someone familiar will be able to add their input.
My husband and I had our marriage based interview back in mid Feb this year. The interview went great and the immigration officer said she was going to approve it once we fax over some few documents she needed. She went told us the green card would take 60 days to get it. She even provided us with the fax number instead of sending us a RFE. The next day after interview she called my husband and requested another documents and reaffirmed that once she receives whatever she needs she will approve it.
While leaving the interview she gave also gave us the generic letter ?your case must be reviewed? It?s been three weeks since I faxed what she needed and the status is still Interview Scheduled. My field office no longer has infopass so I can?t even inquire about the case and my husband never saved her number which I?m so mad about.

Our two year wedding anniversary is approaching in 3 months and someone I know told me immigration has 120 days to make a decision. The person told me if it was him he would let time run by and not inquire so a 10 year greeen Card will provided once 2 year anniversary hits. He said maybe the Immigration Officer has put the file aside for that purpose as well. I?m not sure how true this is but I?m conflicted on what to do. Should I just let time run by and just renew my ED which expires in 4 months?

Anyone with input please feel free to comment.
    Thank you.

From threads that I have read:
    - some people status never change, stay on interview scheduled even after more than a month that they get the GC
    - if the IO asked for documents, it takes around 2 months to get the GC (at least more than a month) in most cases

I think you should get the GC before the EAD expires. You can wait this month, and if nothing happens, then start the EAD renewal process.

Your case is a little different than mine. We went for the interview and everything was fine as well. Interview was done Jan 28, we got the same letter Under review and noting has changed online as well just like yours, No RFE up to now and she never mentioned she needed one.

Our 2 year anniversary is April 4th next month, so at the same time I want to wait until then so that we could potentially get the 10 year green card, at the same time this waiting is terrible.

I was able to scheduled an Infopass for next week, but I might not be able to attend it since I have a doctor 1 hour later. Also my field office will stop doing Infopasses Starting March 18th.
