  • Notice of Intent to deny Aos form I-485

    Hi everyone, please I would like to know if there's anyone in the same boat . I got this letter from my state office following the Aos interview held on Feb 1. Officer said my medical form i-693 is expired. That she will inform how to send it after 30days. Yesterday i got a letter stating my medical form 693 is more than 60 days prior to the submission of the form i-485. In view of the above facts, " it is concluded that you are ineligible to adjust status in the Usa under section 245 (a) of the Ina act because you are inadmissible to the United states under section 212(a)(1)(A) of the Act. We will not make a decision on your adjustment application, form i-485, for the next thirty(30) days. During that time you may submit in a sealed envelope a new updated form i-693 ...performed by an authorized surgeon. Send it along with this letter....." to this field office. In all this what is my fate?
    And where does it leave me? Thanks you for your candid opinions.

    Just file an updated form as they want.

        Do you have the new I693 in sealed envelope?

        Day 1 - Package received at the lockbox
        Day 999 - Card delivered to me - Aug 2021

            Sorry, I mean, did you get a new I693 after your interview when they said that your form is no longer valid/current?

            If yes, then send that, if no, then get a new physical as soon as possible. If you don't file the new I693 before the 30 days you will not get GC.

              I haven't got the new i693. I will get the new medical done this week .Hopefully, I am mailing it as soon as possible. Thank you for your kind suggestion.

                Did you submit the I-693 with the initial application or did you bring a sealed envelope to the interview?
                Applications: I-102, I-485 and I-130

                PD: 7/24/17
                Biometrics: 9/2/17
                We are scheduling your interview: 9/5/17 (then updated to March/15/18)
                EAD: October 2017
                I-102 approved on: 7/25/18
                EAD renewal and Advance Parole package received - 12/01/18
                EAD renewal being worked on - 12/05/18
                Interview scheduled notification received! - 2/6/19
                Interview - 3/26/19

                  You have to submit the medical within 60 days of the CS signing it. It sounds like you submitted later than 60 days after it was signed, hence it is not valid. Easy fix - do a new medical ASAP, like tomorrow morning! Then send it off right away! I wouldn't waste a single minute as USCIS is strict about time.

                    That is the new policy....

                    The U.S. Citizenship and Immigration Service (?USCIS?) have just announced a change in their policy regarding the validity period of a Form I-693, Report of Medical Examination and Vaccination Record, when filed in support of a Form I-485 Adjustment of Status Application. Effective November 1, 2018, the I-693 medical report will be valid for two years from the date of submission to USCIS (and not one year as it is currently).

                    At the same time, USCIS are shortening the I-693 validity period to 60 days from the date the Civil Surgeon signs the I-693 medical exam (it used to be one year).

                      Actually, USCIS is now requiring I-693 medicals to be filed within 60 days of the date the Civil Surgeon signs the medical exam.
                      You can submit the form at anytime during the process, but we Have to be mindful of the 60 days validity.
                      Let?s say the surgeon signed your form, January 1, 2019 then you have until March 1, 2019 to submit it. I hope that helps

                        Thanks folks for your questions and suggestions. You're so special. I have just done a brand new medical I-693 to forward as soon as I collect from the surgeon. I appreciate your input. Hang in there. Keep hope alive. When the time is right, everything will be fine. Don't stress ..lot of patience 's needed in this exercise. Cheers!!
