I-485 Supplement A

Do we need to file I-485 Supplement A?

-- My husband overstayed his six-month tourist visa, and I cannot tell if we need to file this form w/ penalty fee in order to process his Adjustment of Status (we are filing all other forms -- I-130, etc).

No.....you dont need the supplement...his marraige to a US citizen allows him to adjust his status in the US without any penalty despite his overstay........the supplement with penalty is for people who would be otherwise ineligible to adjust their status but who filed a I-i30 prior to april 30, 2001 and pay the $1000.00 penalty
