  • Expired H-1 visa, married a citizen after

    Hello,

    I have married a U.S. citizen on October '05, but my visa expired on Sept. '04. I went to my country's embassy to try and renew my visa, but this was before I married her (went there in August '05). It was rejected.

    Now the advice I need is: What should I be doing right now? It sounds like Adjustment of status is the one I need to apply to... but what about my legality?

    hey this is 1babygirl, i went through the same with my ex-husband. all you need to do is contact a lawyer and he will start the process of your legality.

      File for adjustment of status. You dont need a lawyer..............file I-130, I-485, I-765, G325 with the photos , fees and supporting documents

        i visited a lawyer a few months ago and told us to wait a couple more months before we file anything.

          now i really do not understand, why did that lawyer tell you to wait before you start the process for adjustment of your status.it doesn't make sense to me.
          i was kind of in the same situation.applied for an extension of my visa, it was rejected, i overstayed my visa for 2 and a half years, then married my husband.as soon as we got married we filled all the forms, paid fees....and sent it off.the sooner you do it, the better.
          i am not sure ,that lawyer of yours is telling you the right thing.i might be wrong, who knows, but it sounds really weird, that he told you to wait.i mean there is no need for you to wait.you need to start your process now.
