husband cheats on me. green card application pending

Hi,

I found out that my husband has been cheating on me and sleeping with another woman. We are scheduled for interview for my greencard on Sept 15th.

The evidence I have: the girl that he slept with 3 months ago is found pregnant and is taking him to court with some DNA evidence to prove that he is the father of the child. She is trying to get him to pay for child support and medical insurance...

Also, there is a conflict for our interview date. my husband has been scheduled to go to court out of state for another charge on Sept 15 - the day our interview has been shceduled.

Should I reshcedule my interview or can I resolve my immigration dilemma by self-petitioning as "abused" spouse? (emotional abuse) Does my case qualified for "domestic violence?"

If we want to get divorce or annul our marriage and still get my greencard, when would be the best time to do so? Should we still go to the interview as a couple
