  • Please Help!!!!

    my original I-130 was sent to the NVC in July. I am wondering if I should file the I-485 while waiting for the NVC to contact me or should I wait? My mother is a US Citizen. Does this make me eliiable for a visa number or not?

    It's all so confusing!!! Someone please help!!!

      yes i am...i have been in the USA since I was 3 weeks old and have not lived outside of the USA.

        looks like we have the same story

        my story is like yours, ive lived here since forever.
        i was ready to enter college when they slapped me in my face that they couldnt help me.... financially.......
        i filed I130 but now i have to go to mexico to get a visa.
        i m planning to get married but am afraid that again they would throw a punch and deny it.....

        that i know of you have to go to mexico in order to take it further.....
        what ive heard is that you go to mexico for the visa and stay there until one becomes available.... it could take up to a year..... yeah i know what your thinking....

        but if i find out something ill let you know.

          Since you are applying through your mom who is a USC you are not eligible to file I-485 with the I-130 that your mom filed, because visa number is not available to you. You have wait till that becomes available and only then you will be able to file I-485. HOWEVER, you have to remember that a filed I-130 gives you NO right to be in the US, therefore while you wait for your visa number to become available you have to maintain legal status in the US, otherwise you will accrue illegal presence and will be barred from entering the States for a period of time (even with an immigrant visa).

            WOW.....way scary!!!

            WOW....thanks for sharing ur story....even the that about having to go to Mexico is like really scary...besides being born there, i've NEVER been there...in all honesty I dont even speak spanish....finishing school is what i'm working on now, well besides this immigration thing...i plan to get married to my fiance in december of this year... so hopefully that will help my situation a little but we'll see about that....again thanks for the story and the help.
