We have been reading lot of information on immigration forums about other people's experience who went to Canada with landing papers to receive Permanent Residence Card in Canada and returned back to USA on Advance Parole/EAD/485 pending.
They were all allowed to USA on valid EAD/Advance Parole but they were all asked by the US immigration officers about reasons to go to Canada and also they took a copy of "landing papers" from Canada. Immigration officers also informed those people that they will give the Canadian landing papers to INS and inform them that they have also applied for the Canadian PR.
ISSUES can be:
A. Once immigration officers inform USCIS, people are worried that it might revoke their pending 485 application or they will receive a letter from INS about reason to apply for Canadian PR? CPBM officers will inform the USCIS for further scrutiny. Also, this may delay the 485 application or cause problem..
If no risk, why do US officers take a copy of landing papers and inform INS??
B. Also, after the 485 approval and when applying for Green Card (I-551), you will be asked to forfeit any permanent residence visa from any country that you are holding. You can only be permanent residence of only one country.
Can the above Statements be TRUE? Is there a risk for pending 485 being revoked or delays in the process? Is there any kind of risk when getting Canadian PR cards while 485 is pending and return on EAD? We really don't want to take any kind of risk and jeopardise 485 application. Or should we just drop the idea for Canada PR and wait for 485 approval? We just applied for Canada PR as a backup plan for any issues with 485 approval.
I have to go to Canada during next week, please ADVICE, ASAP..
