  • Very quick Yes/NO question - please help

Applied for I-485 package. Got a notice for the interview. I know for sure that a temporary greencard will be stamped on my passport on the interview day.

Question: Am I officially authorized to work in the US at the moment after the interview afterwards or do I have to wait for the greencard to be mailed to my residence to be authorized for work?

  • #2
Ok So I googled around and found out I am authorized to work at the moment the stamp on my passport. Another question I could not google out is I got the I-485 interview notice with my A# on it. Does that mean anything in terms of work authorization and such?

You can work as soon as you get the stamp BUT there is no guraantee youre going to get the stamp that day. You will get it only if:

      1) Everything is o,k and your case is approved that day AND
      2) Your background/name check is already completed
      3) your einterviewing aService Center that stamps passports ( and you hav e avalid passport) Not all centers do stamping, some ask you to wait on the mailing of the approval notice nad Green Card

        Thanks for your prompt response!
My case is in San Jose, CA and cases of other people showed that they do stamp passports on interview day here so I m fine with ur #3 possibility.

I've done a great job turning every possible documents requested and I dont think I would miss out anything as well as wil lbring everything required on the interview day. The marraige is real and been going on for like 4 years. So ur #1 and #2 kinda hard to happen to me. Good for me I know

The question is I got the interview notice with my A# on it does that mean anything in terms of working authorization at all or Have to wait till stamp?

That is an alien number assigned to you which doesn't say anything about i-485 approval or stamp.

          Good Luck,

            A number and working

You should have filed a work authorization application while waiting for your adjustment interview! Having an "A" does not mean that you have authorization to work.

                i hope it help

i hope this will help you. Go to this website www.uscis.gov then in employment authorization...then to How do i get work permit....then fine the who is eligible...to make it short this is just a part on what it says....

                Who is Eligible?

The specific categories that require an Employment Authorization Document include (but are not limited to) asylees and asylum seekers; refugees; students seeking particular types of employment; applicants to adjust to permanent residence status; people in or applying for temporary protected status; fiancés of American citizens; and dependents of foreign government officials. Please see Form I-765 (Application for Employment Authorization) for a complete list of the categories of people who must apply for an Employment Authorization Document to be able to work in the United States.

If you are a U.S. citizen, you do not need an Employment Authorization Document.

If you are a lawful permanent resident or a conditional permanent resident, you do not need an Employment Authorization Document. Your Alien Registration Card proves that you may work in the United States.

If you are authorized to work for a specific employer, such as a foreign government, you do not need an Employment Authorization Document. Your passport and your Form I-94 (Arrival-Departure Record) proves that you may work in the United States. Please see 8 CFR 274a.12(b), which provides a full list of the categories of people who do not need to apply for an EAD.

and also heres in Permanent Residence...in section How Do i Become a LPR....says........Will I Get a Work Permit?
Applicants for adjustment to permanent resident status are eligible to apply for a work permit while their cases are pending. You should use USCIS Form I-765 to apply for a work permit. You do not need to apply for a work permit once you adjust to permanent resident status. As a lawful permanent resident, you should receive a permanent resident card that will prove that you have a right to live and work in the United States permanently.
