  • I-485 pending now 2 years! Background or LOST on a desk?

    I'm so frustrated!

    My husband is a USC and he filed a I-130 for me 2 years ago ( in 2004) after we were married. At the same time I filed the I-485. We had my bio-metrics done weeks later, and our joint interview 6 months later...which went fine. However other checks were pending. So we were told to "wait".

    Ok... its been pending now over a year and a half since then!!! Still no I-130 or I-485 response from INS. What can we do? We've filed numerous inquiries and onnly told "its pending, check back in 6 months?"

    Also we are afraid to leave the country together without having my GC since we've heard that Advanced Parole I-131 travel document doens't " guarantee " re-entry, IS THIS TRUE????



    Please advise!!!!

    I am in the same situation as you are.I filed my marriage based I-485 along with I-130 in the June 04, had the interview 7 mths after, everyting went fine to it's merit. I was asked for a second set of fingerprinting for the I-485, cause the USCIS said the 1st finger printing had expired. To this date my FBI background check has been pending. I think there is a way to SUE to the USCIS in these matters, can any one give more information in this matter.
