On the application of I-485, can the applicant include her dependent (wife) eventhough shes already out of status?

He's on H-1 status, had certified LC and I-140 approved. His lawyer said that we are just waiting fot his priority date to be current. Can he include me on his application once his PD is current even If Im out of status already?Comment
