AOS still pending, relationship not going well, got pregnant

  • AOS still pending, relationship not going well, got pregnant

    Hi. I married my husband over, an USC, over a year ago, applied for AOS, had the interview 4 months ago but didn`t get either approved or denied.

    we got pregnant a little after the interview took place, but the problem is that we are not getting along anymore and it looks like our marriage would be short term. I am wondering what can be done in the case I get a divorce but become a new mother. would my case be denied? i do have a decent job and i am financially stable, but my visa is way expired... would I become illegal, or am I able to change my status still? thank you

    Hold off on any divorce talk for now. If the baby is born before you get an answer, send a letter inquiring what is the status of your application AND send a copy of the childs birth certificate with the fathers name.

    if youre denied, yes, you would become illegal but a denial is unlikley unless you ahve some documentation missing or some othe rproblem youre not stating here.

      we just received an appointment letter for another interview in a month!
      I`m guessing it`s cause my husband doesn`t work, and hasn`t worked in a while ( part of the reason our relationship is going bad); a good friend of mine came in as a joint sponsor, so we must`ve passed that... can`t think of any other reason, we had a bunch of stuff in our names: vehicles, credit cards, lease..
      If we go to the interview together we`ll do terrible, we fight all thime these days and agreed that it`s best to take a break and don`t spend to much time with each other.. our baby is due in april-may, so not for a while...so i find myself in a very hot spot. any loopholes in the system about that, or a way out?? thank you

        You dont need a loophole or a way out and you MUST go to the interview together.
        Sometimes God ( whomeve rhe might be to you) provides us with answers and we ignore them , chose another route and when it doesnt go well, we say were unlucky. Your pregnancy is actually a blessing and no youre not being called for a second interview because of the sponsorship but rather because the first inteview did not convince them that youre really married and living together. If your pregnancy is not showing, you MUST find a way to bring it up..and make sure you bring some documentation to show that youre pregnant and when you got pregnant.

        In the interview, you will be talking to the officer, not to each other so you dont have to get along. As long as both people tell the truth you should be fine. If your spouse is not providing an anser and you think it will hurt your case, you can inject (politely) or wait for your turn and indicate to the officer that youre fighting and not getting along so well because hes frustrated that he cant find work . Also, you just have to probably swallow your rpovide and recognize that its your butt on the line and not his, so, even for a few days , as hard as it may be, soften up your spouse so that he goes to the interview in a good mood.

        Do not howevrr admit that either party is thinking of divorce...whatever you say it must indicate that its just a breif rough period and that both of you are working on the marraige. Good luck and Im sure it will go well but whatever you do, do not ignore that interview. You MUST go.
