      Re

      Hi Meethawks,

Well the marriage-based interview consists of the I-485 applicant and spouse having a face-to-face interview with an Immigration Officer at a local USCIS Office. There are a few reasons for this interview like scrutinizing your I-485 application information, verifying its contents, and to have you and your spouse together prove the legitimacy of your marriage.

There is a plethora of questions that can be asked but some of the most common are:

1 Where did you meet your spouse?
2 Whats your spouse's place of birth?
3 What is your spouse's birthday?
4 How long have you been married?
5 How long have you known each other?

Oftentimes additional supporting documentation to prove the legitimacy of your marriage is required by the Officer. Such documentation MAY include but is not limited to joint bank accounts, joint lease agreements, joint car ownership of vehicle, joint health insurance, joint car insurance etc. Bear in mind that these interviews CAN be very dynamic and there is really no real cut-and-dry interview. It really depends on the attitude and personality of your Officer and the manner in which you and your spouse handle the interview in the initial stages.

Question:You said that you have your interview in March...Does this mean that you have an interview notice? I got an interview notice and it goes into great detail about the location, date and time of the interview and provided a list of supporting documentation that I should bring to the interview. Im just curious to know what kind of documentation you received from USCIS.

          hi howiej1

Yes the same notice from USCIS. And God! Lot of documents demanded. Birth cert, marriage cert, photo identification, all docs received from uscis, EAD, all documents which can add up to prove ur ongoing relationship, passport, cert of naturalisation of spouse, etc etc.
But anyways thanks for the advice.

And u said, u received a notice from uscis that EAD has been ordered on Jan 17th. and received it on Jan 22 rite.. Then it gives a smile on my face, as I received the same notice on Jan 19th. So I should get my EAD this week...? Hope so...

            RE:Chrisusa and Meethawks...

            Hey Guys,

Its seems that you guys are only two full days behind me regarding the EAD card production. I cant say with full certainty but I believe that you guys will get your EAD cards before this week is out!!! I was completely shocked to find my card in the mailbox today!!Given the weekend and all I figured I would have gotten it by this Thursday or Friday. So with a full four days left in the work week I truly believe that you guys will have those EAD's this week!

Please post to let me know when you do get them. Oh and Chrisusa, I think its highly unlikely that you will receive a RFE at this late stage in the game. From my understanding RFE's slow down the EAD process and your EAD would not have been issued with USCIS still needing additional evidence from you.So I think its safe to say that if your card production has already been ordered its just a matter of WHEN you will receive your EAD and RFE's are a thing of the past!!Congrats to you and Meethawks and lets continue to share our experiences.

Hi today I received an e-mail from uscis that we have mailed at ur address the approval of I-765.
They wrote: Application Type: I765 , APPLICATION FOR EMPLOYMENT AUTHORIZATION

                Current Status: Approval notice sent.

On January 23, 2007, we mailed you a notice that we have approved this
I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION. Please follow any
instructions on the notice. If you move before you receive the notice,

So Howiej1, What should I expect in the mail? will it be an EAD or Just a letter of Notification.?

                      Hi Meethawks,

I already have a social security number.I came to the US in 2001 in F-1(international College student) status and obtained a social security number that way. However, my social security card say "NOT VALID WITHOUT INS WORK AUTHORIZATION". Once I get my green card I will apply for the unrestricted Social Security card but I had a pre-existing SSN since my college days.

                          RE:info on post EAD

                          Hi Chris1236,

If you havent received your Interview letter as yet I am certain you will have it in short order. However, I am a bit surprised that you have received your EAD and no Interview letter as yet. As I navigated over this site the last few months Ive noticed that many person have received their AOS interview letters prior to their EAD cards. However, I cant say much more than that not knowing any significant details of your case. Please post some case status info and I may be able to answer your questions better.

If your work is the reason why you and your wife are constantly aways from each other then I believe the Immigration Officer will be understanding of this fact and it should not be a problem. Just be truthful and honest about this issue and provide whatever documentation that you can about the work related issue. As long as you marriage is legitimate and was entered into in good faith, the separation for work will probably be an insignificant factor in your AOS.

When you receive the Interview letter it will include all the relevant info about time, place and location of your interview. In addition, this letter will inform you of what supporting documentation you should also bring to prove your marital relationship. For questions regarding the interview please refer back to yesterday's conversation between myself and meethawks and you will find the info.

                            thank you howiej1

thanks a lot for the detailed reply howiej1...lemme give some of my case details so that u can have a better idea of my case
i came to the US in 2003 on an F1 visa ...since i was a student i got an ssn
i was out of status in 2005 due to some academic related problems..
i got married to an USC in june 2006 ,and applied for an I 765,485,131 simultaneously in october.then i got a couple of documents from the ins office and they say
                            recieved date oct 5 2006
notice date oct 11 2006 then i had my biometrics taken on 27 of oct
and in nov i got to send some RFE..
in january i got my EAD ..but dint get any interview notice...
so i was jus wondering if it is mandatory for evryone to attend the interview...after u get an EAD...or is it possible to have an interview later on before ur second anniversary,....thanks a lot
                            regards

                              Hey Chris1236,

IF you got married in June 2006 and filed thereafter, it is very likely that you will be called for an interview. Virtually all marriages under 2 years old are approached with considerable scrutiny by USCIS, thus resulting in an interview. I am sure you just havent received your letter as yet. USCIS is a strange animal and persons sometimes fall outside the norm. You will receive the letter soon. However, no one can say for sure when your interview will be but you will have one.

For a marriage-based petition your petitioning spouse must attend with you. It is stated in bold and underlined on the Interview Notice Letter. There is no way around that in my opinion. One more thing, try to attend your interview on the date scheduled in your letter because rescheduling may give you an interview a few months later!!!Any rescheduling with USCIS CAN cause a long delay. Just stay hopeful. You have your EAD so at least you can work. Just bear in mind that USCIS doesnt always do things in logical or chronological order!!!!!!
