RE: applying for H1 while being on i-485 thru Wife

Hello,

I wanted to find out if it is possible to apply for H1 through an employer if someone is on i-485 through his US Citizen wife. If there is,what are the standard guidelines?

Also, if someone abandones his/her i-485 application and gets divorced simoultaneously, what happens then? will the joint sponsor be affected?

1. You can apply for H1 on your own as if nothing has happened.

2. If you get your divorced, your I-485 would be invalid and you will have to look for employment based greencard.
