      Fchiriani, thanks for posting your timeline - very helpful! We noticed that you did not mention filing an I-130 as part of your family based petition. Had you already filed this form or was it unnecessary?

      We are starting the AoS process (I'm married to a US citizen and currently in the country on a tourist visa) and are wondering what circumstances require/don't require the I-130 form...

        I filed the I-130 first, right after I got married. I got approved within 3 months. Some people file all the petition and applications together. At that time I didn't know that, so I read that I need it to file the I-130 and once approved file the I-485 & others.

        I guess on all cases of family based you need to file I-130, and I think the process could go faster if you apply for everything at once, you should check into that.

          fchiriani is right...

          you have to file I130 for all family based petitions...
          It's the first step for family based immigration
          petition for immigrant visa(130) + adjustment of status(485). Also, if you file 130 earlier (if spouse was on GC), then you ahv to notify NVC seperately after spouse becomes Citizen to upgrade your petition and grant 485. I am going to file it all together once I get my citienship cert...keeps things simple.

            I am on a k3 visa from India .just arrived in USA .my question was i have filed in I-765 and need to file I-485 . how long will it take to process all the forms and when will i get my SSN number and the greencard and the permission to work

              I-485 & I-765

              You will have to file the I-485 and based on that you apply for the I-765

                  Green Card!!!!

                  Hi everydoby, I just wanted to update my post here. I got my Green Card on Friday!!
                  The whole thing took 3 months!!!!!

                  Family based Pettion (marriage)
                  12/29/06: FORMS I-485 & I-765 sent to Chicago, IL
                  01/08/07: Receipt for I-485 & I-765
                  01/10/07: ASC Appointment Notice
                  01/26/07: Biometrics at USCIS St. Paul, MN
                  01/25/07: Initial Interview request due on 03/13/07.
                  03/13/07: CASE APPROVED
                  03/23/07: GOT GREEN CARD IN THE MAIL!!
