  • Special / Different -married for2years already

    Hello,
We are a married couple for almost two years now but did not necessarily have to fill out the paper work (I-130 or I-485) since I am still in college.

    Story in short:
I am student in the U.S. since Aug. 2003
I met my husband and we got married in Oct. 2005

We still haven’t filled out anything that would allow me to stay after my graduation.

I am here right now on my
F-1 visa, which will expire in 2008,
I have already a Social Security Card,
    and an American Driver’s License
    .

What next steps do we have to go now?
Can we skip any since we are married for almost two years now?

    We appreciate any input!!

    Re Special

    Hey There.

I am a student as well and I came to the states on a F1 visa. My wife is a U.S citizen and we are almost married two years and just recently applied for my change of states.

If you are F1 student and married to a Citizen you still have to file Form I-130, I-485, I-765 the hole Change of status package.

I am sorry to say but you can’t skip anything. The plus is because you a married to a citizen you won’t have to wait for an immigration visa to come available for you. When they approve your I-485 one will be available. The only thing in your favor is the fact that you are almost married for two years. Because of that when they approve your I-485 they will give you your green card and not the conditional green card
