My situation is
1. Both my I-140 and EAD were approved towards the end of March 2003.
2. EAD is approved, but not received the physical card yet, BCIS is yet to mail it.
3. I-485 was filed one month after filing I-140, in mid Oct 2002.
4. No FP notice yet.
5. My employer is planning a big time layoffs very soon.
6. EB2, RIR and no-consular processing.
My questions are
1. EAD card, I am hoping that I will receive it before layoffs occur.
Does this really matter? the approval date is end of march 2003.
2. I have completed 180 days from the date of filing I-1485, but not
from the time I-140 is approved. So what happens if I get layed-off?
Do I need H1B again to get a new job?
3. No FP notice yet, is this a matter of concern?
4. My current H1B Visa expires towards the end of this year. Can I switch
to EAD now? How do I do that?
5. What documents should I obtain from my current employer/lawyer if I am
layed off?
6. What are the benefits and negatives of me switching to EAD status
from my H1B status?
7. The fact that EAD approved changes my status or I(or my employer) have to
take some action in this regard?
