  • Birth Certificate from Consulate General

    My attorney has advised me to furnish a birth certificate for my I-485 application. I do not have a birth certificate.

    Is a birth certificate issued by the Consulate General/Embassy of India in US considered valid or should I get affidavits and other documentation from India ?

    I don't have hands-on exp on this. But from what i heard from my friends, the one that you get from the consulate general is worded in such a way that they are merely repeating what is stated in the passport as your birth information.

    You may use that for the time being [to satisfy the checklist for I-485] so that you do not lose time. In the meantime, do the necessary logistics to get the actual birth-certificate from your home town or the "Non-availability" and "Affidavit of birth" documents. This process of getting the actual BC takes a minimum of 2-3 months and may vary depending upon your reach.

    Worst case, you will get an RFE and if you have your birth certificate [or affidavit et al] by then, you can submit those at that time.

    It all depends on the time you have on hand .........to wait now till you get your BC or handle the RFE.

    I agree that this is not an encouraging reply, but people have gone that path, so i just thought of sharing with you.
