My I-140 (EB1-A) petition was approved at CSC. Details:
RD 1/15/02
PD 1/12/02
ND (approval) 3/5/02
(NO RFEs)
I self-petitioned, attorney assistance.
I credit the speedy adjudication to either the excellent factual case my attorney help me assemble (I qualified for seven out of ten criteria) - or just the luck of the draw at the CSC.
I then filed my I-485 as follows (also filed wife's I-485):
RD: 8/8/02
ND (receipt): 8/9/02
FP: 09/02 (online status updated that FP results were received late 09/02)
PD: N/A
The five months lag between I-140 and I-485 was so that we could get absolutely complete documentation together, medicals, biographic stuff, etc. to file with the I-485 (and the fact I was working insane hours on my existing O-1!)
EADs and APs were applied for at the same time as I-485. APs arrived quickly - about four weeks, but EADs took about 100 days, which was fine as I was still in O-1 status.
My questions are around the procedures and processing times.
a) I've read conflicting information about the likelihood of getting interviewed. I'm not worried about it as I and my wife have maintained legal non-immigrant status over the past ten years (me O-1, her combo of H1 and O-3). But I understand that if an interview happens, it can add significant time to the already arduous wait because your file needs to be transferred from CSC to district office, etc. Anyone with an approved I-140 in the EB1-A category have any experience with being requested for an interview? If substantial documentation was already provided (tax returns, full I-94 history, supporting docs for category requested and approved), what would be the types of information being sought in an interview? (Especially as EB1-A self-petitioned does require an employment offer - though I am still employed by my last O-1 employer). I know sometimes 'random sampling' interviews occur.
2. My attorney says that the fastest I-485 approval they've seen recently out of CSC is 1 year, longest 2 years, with many coming in around the 18 month mark. But they also say that EB1-A AOS cases require more 'thought' at the CSC, therefore may take longer than average. Anyone with recent approvals in this category? How long? It's been about nine months since we filed - we expect to possibly wait another year and a half.
3. My wife has applied for AOS Derivative Adjustment, based on my application. Are our applications treated together or separately? For example, might one of us be interviewed without the other, or might the cases take different lengths of time to adjudicate?
