Hi,
I've read what I could find here on this, but nothing seems to fit the situation I have in mind.
The situation is that a Russian woman married a U.S. citizen via the K-1 process, became a U.S. citizen, and then convinced her Russian citizen mom to stay and immigrate to the U.S. when she was visiting here on a B-2 visa. The daughter filed an I-130, the mom filed a I-485 (simultaneously) and they are awaiting a ruling on those.
What kinds of questions can they expect during the AOS interview when it finally happens? There was no preconceived intent to immigrate at any time, but do they need to be prepared to show documentation that that was the case? If so, what would qualify as documentation? The mom quit her job in Russia when she decided to stay, and canceled her financial obligations there as well.
I understand that a 1980 court ruling held that even if it exists, preconceived intent is not sufficient to deny AOS for an immediate relative. Does that mean that in these situations, the preconceived intent issue will simply never come up?
Thanks!
