I would just like to clarify my understanding of what I have read/heard about the I-485.
I just got married a month ago to a wonderful woman from Belgium, and we want to get her status adjusted.
My question is this... She has entered the country legally on a 6 month visitors visa which will expire sometime next month. Now if we file the I-485 after her visa has expired will this be a problem? Now if we hurry and get all the forms and stuff done before her visa expires, there will be no way to get approved before next month anyway, is this a problem?
From what I understand as long as the person has entered the country legally then there is no problem if the visa is expired, when I say no problem I mean like they wont deny the paper work on that ground. I understand she can't go back to belgium or any other country for a visit or anything.
