My 9th year H1 extension approval is still pending with a receipt date of MARCH 13th 2007. My priority date has become current & I am ready to apply I-485. Meanwhile, back in India, my father's health is seriously deteriorating. So, I have to make an 'Emergency Travel' soon after filing I-485. Could you please advice which is the best option for traveling soon after filing I-485:
1) Even though my priority date became current, can I still get my pending 9th year H1 extension approval? If so, after filing my I-485, can I immediately travel to INDIA without having to wait for the 'I-485 Receipt'? Also, can I get my 9th year H1-visa stamping at the consulate without any problems and re-enter US on it?
(OR)
2) I will apply EAD/AP also along with I-485, wait for 'I-485 Receipt' & get my AP/EAD from the local USCIS office with 'proof of emergency' & then, travel to INDIA and re-enter US on AP?
