  • Adding Spouse to I-485 Later

    Hello,

I have an approved labor and my priority date is Mar-2005. I havent applied for my I-140 yet. After yesterdays changes in the priority dates advanced, I am now CURRENT and can apply for I-485. I have my H1 visa expiring in Oct-2009 (3 year extension after first 6 years).

I am getting married on Aug 30 2007. Is it a good idea to go ahead and file I-485 now (because of the fear that dates might retrogress shortly) and use my H1 to get a H4 for my wife on Sep 3 2007 and then add her to I-485 as soon i come back to US on Sep 16. Is this a good idea ?

Can you pls. suggest what you think is a good idea. Due to job constraints, it would be very difficult for me to get leave for me before Sep for marriage.

    thanks n regards,
    Rupesh

I am in a situation that i applied 140 on may and i am not married.
since the prioritydates are current if i apply for 485 now can i add my wife to my EAD later.

Till now i did't even think of marrying soon. thinking that my priority date is jan 2007 so its gonna take long time for priority date

        i485 before marriage

I actually filed for my I-485 before the retrogression in oct 2005. I am getting married in december. my priority date is april 6, 2004. Now with all dates becoming current, my I-485 petition could be approved soon. So, i am going to be withdrawing my i-485 petition, and apply for it with my wife sometime in january, if the priority dates are current.

I would suggest not applying for i-485 if you are still single.
