I am living with my child in this country. I am married(Hindu marriage) in India and my marriage was not registered. I am not living with my spouse for several years. My spouse lives in India. I am not legally separated or divorced. I have the custody of my child from an indian court. While filing for the custody I mentioned that I got married to such and such a person and all the details. I have the court order for the custody of the child. My attorney says that we can file I485 without marriage certifcate, but they may ask it in future. So it is better to get the marriage certificate before filling. My spouse filed a divorce case in India long back and I refused to give divorce. In that paper he mentioned that we got married on such an such a date by hindu act. I have a copy of that. These are the only proofs I have. Is that enough to produce if I get an RFE of marriage certificate. Any help is appreciated.
