  • I 485 filing for dependents

    I got my Labor approved and my I140 was filed. Now since the I485 dates are current I am trying to file for it, but my wife and child are in India on a summer vacation do they have to be present while I am filing I485 or is it fine if the papers are got signed by them and now one more question here is my wife just got approved for H1. Does my wife has to change the status back to H4 or can I file her as my spouse even if she is on H1.Please advice.

    Relax!! I-485 dates being current is a scam. As of now there are millions of people applying for I-485. The quota for EB2 and EB3 is only 40,000 per year. In the past 3 days since the quota began, already 400,000 people must have applied for I-485. That means it will take 10 years for these guys to get their green cards. What happens next? Everyone who applied for I-485 will get EADs and then there will be a retrogression again. EAD is valid for 1 year. So, they must pay EAD fees + Advance parole fees + lawyer fee (approx $3000) every year to continuously renew the EAD.

      Renewal of EAD and AP under new USCIS fee schedule

      But don't the new USCIS fee schedule include an elimination of fee for interim benefits,meaning for renewal of EAD and AP?
      This would mean that there is no charge for renewal of EAD and AP even if we are doomed to be stuck with them for many years.

          Adjustment applications and ancillary benefits – The new application fee for an I-485 is a package fee that includes associated EAD and advance parole applications. Thus, if you file an I-485 with the fee listed above, while you will still need to submit applications for an EAD and advance parole, you will not need to pay a separate fee so long as your adjustment application is pending. However, if you filed your I-485 before this fee change, to apply for or renew your EAD or advance parole, you must file a new application with the new fee for those applications

            I think thousands like me r in similar situation....
            My question is about staying in US.Is it a must to stay in US after applying for I-485 in july 2007..If so, how long..?Can anyone pls shed some light on this...
            This will help me take some important decisions....

              Yes to file I-485 you need to be in the country so call them back if you dont want to miss the boat, if you are lucky you will have till Sep 2007 but the only guarantee is till July 31 2007. We will know about the August around mid July.

              So if you want to gather the documents right now and have the packet ready and wait for the next bulletin before you change travel plans then you can do it.

              I am saying get all the documents ready book medical testing appointment ensure all vaccines are current. For family in India get this done there and get records from there to provide to the authorized doctor here.
