Travel to India immediately after filing I-485??

Hi,
My Husband is in H1 and me in H4. We just got the second stage of GC cleared. We are about to file I-485. And also our H1 is getting expired by oct 1, 2007.In the mean time I (h4 holder) have to go to India for 1 month urgently. But I'll be back by Aug,2007 before our H1 visa date expires. My husband, the H1 holder is not travelling with me. Will my travel out of the country in this situation create any problem to the filed I-485? And also will it create any problem reg the visa expiration too? If so what could be done?

and ya i have got confirmation of the same that we can travel after applying for 485 with a valid visa (I-94 validity) from an attorney and also a couple of my friends !!!

Situation that I have:

1. Assuming that my lawyer files mine and my wife's 485 on july 1st.
2. My wife is travelling on July 7th to india on a valid H4.
3. Until July 7th, 485 Receipts are not received
4. Can my wife travel to India on H4 and not having 485 Receipts.

5. If she can travel without receipts, what is the consequence when she comes back to US after 3 weeks.
6. Assuming that there is no problem at the Immigration,a new I-94 is issued.

7. Will this change of I-94 RECORD result in issues for my wife's485 application, at the time of processing ?

I have a question here , provide suggestions will be great help

I am applying I-485 in first week of July , I am planning to travel to india on md of august with my family.

I have a valid H1 , My wife have a valid H4 Visa and my wife is converted from H4 to H1, She want to go for H1b stamping in INDIA.

Did she can travel without any problems after applying I-485, with her new h1 or with old h4 ?

hello everyone !!!

sorry for not responding to ur mails .....
i understand we can travel if we have a valid visa i.e., H1 or H4 ...and we also need the 485 acknowledgement...so i suggest anyone who plans to travel, travel after u get the 485 receipt/acknowledgement.....

by saying "These classes of individuals may file for advance parole while in the U.S." , they mean that we have to be physically present in USA when 485 is being applied...and how do we know it is applied, only when our attorney confirms it to us, or we get an acknowledgement saying that they received our application.

this is to the best of my knowledge i know and am sharing with u all ....i am also in the same situation, my H4 is valid till sep 30 and i have a ticket to india on july 8th ...i guess i am gonna cancel that, and wait till i get the 485 receipt and then travel, but ya do come back before ur visa expires ....so that u can avoid the fuss of stamping or advance parole .....

lets hope for the best and keep our fingers crossed and hope that we get our reciept nums asap ....
