  • no-availability cert and birth cert from indian embassy

    Hi
Can you please let me know if this is possible ?

If I cant get the no-availability certificate from India, I heard
that I can take a birth certificate from Indian Embassy (im close
to San Francisco) and then produce affidavits from mother
    and father.
Does the affidavits along with a birth certificate from indian embassy (instead
of no-availability certificate), satisfy the birth certificate requirements ??
Has anyone done this kind of thing.

Or what can someone do in cases where they cant get
    a no-availability certificates ?

    Please let me know.
    Thanks
    Bobby

I am also in same boat.
    Senior pls help me.
I am not able to get non-availability of BC and relying on affidavit from parent and BC issued from indian consulate.
Also, just one affidavit signed by both parent is ok - OR - I need another affidavit from close relative.

    Thanks.

BC issued by Consulate doesn't work and you have to get seperate affidavits from your parents. This is what my lawyer told me.

        Hi Bobby and Apps,

I am the sae boat too. I dont have a birth certificate and got one issued from the Indian Consulate Chicago based on the passport. Also I ahve affidivits from my parents and Uncle which is notorised.

Pls let me know if this is enouh for filing.

I enquired about getting a non availability certificate from the place where I was born, but those guys are very straight forward and they say that I need to approach the court and file saying that my birth has not been registered. And when the court gives an order to the municipality to search and issue a "Non availability" if the birth records are not found. This is going to take for ever I guess.

Can you pls sugest of any other way out?

Kindly giving your suggestions. It will be of great help.

        Thank you very much.

Give it a try to get the non-availablity certificate. Atleast in the AP state it is not a big issue. My brother approached the cleark in the registar office and asked for the birth certificate. He searched the records and told that it is not avaiable and issued the non-availability certificate in the format defined by the State Govt. The cost was Rs 50 (official fee) + 100 (unofficial fee)
