Hi,
Currently I am on F1 status and working on my OPT that is valid till Dec, 2007 and my application for H1B is pending. I am planning to file my AOS along with my husband, I have following questions please respond its urgent.
1- If I will file my AOS with H1B pending along with my COS(change of status from F1 to H1), will me COS get voided because of filling my AOS.
2- If I will file my AOS after H1B and COS approval in that case also will my COS will get voided.
3-If my COS gets voided, to start work on H1B I will have to go outside USA and get my visa stamped in that case If I am departing on F1 visa and entering on H1B will my pending AOS gets voided.
Please reply its urgent, We are talking to both of our company attorneys and both are giving conflicting replies.
