  • Divorce and 485 Processing

We were married in India in May 2002. It was an arranged marriage and at that time we did not know one another. We have no children together.
Shortly after our marriage, I returned to the US and my wife stayed in India. In December 2002, my wife came to the US. In January of this year, she notified me that she has been having an affair for the last six years. She stated that the marriage was forced upon her and that she has continued the affair after we were married. We both decided that a divorce is appropriate.

My wife is on H4 and I have filed for her 485 . Her FP was done on Dec 10 . The receipt date on the 485 application is Aug 2002 for her obtaining her green card through me; however, I do not want this to happen. Her family has been pressuring her to remain married to me until she gets her green card, but I would like a divorce as soon as possible.
Please let me know if anybody has had similar experience or if there are any suggestions. Thanks in advance.

I hope nobody has to go through what you have gone through. I highly recommend you to consult an attorney as soon as possible. You may spend few extra dollars right now but that will save you a lot in long run. Once you are married there are lots of complications(depending on what state you are in).......

      My Friend pleasehelp2003,
It looks like she has an affair in India after your marriage which is unpardonable. It also shows that she is not interested in getting GC and settling here. She is always safe and you are the one who will suffer.I presume that you can not apply for divorce here in USA. Also ,think about the risk of paying alimony. I advice you to wait till your GC gets approved and go back to India to get divorced and not spoil her future . Also, consult our Indian attorney before taking hasty step.
