    Hello,

    I am a Canadian Citizen and last week I filled I-485. I am visiting Canada next week and my question is do I need to apply for Advance Parole to re-enter in U.S. Can someone help me?

    Hello if you have applied for a 485 and i assumming you are family based..you MUST have a Travel Document to travel outside the US.
    The sad news is, it takes about 3-4 months after you have applied for one to receive it. Until then.. you are stuck in the states (believe been there and done that for too long).
    If you try to get back in the states without an authorized travel document they simply wont allow you back in and you will be forced to start your entire immigration process over.

      I am in the same situation. As previously stated, you are barred from travelling outside the US until you either get your advance parole document or your green card is approved. Once you step outside the US, you will have forfeited your application and most likely will NOT be allowed back in for a certain amount of time.

      Also, 3 to 4 months for the parole document? That is so ludicrous. I applied June 14, 2007 for it to travel in September. I guess that isn't going to happen!

        you are barred only if you are using EAD to work. If you have an independent work status with dual intent like H1 of L1 and Dependant visa then you can travel with I-485 receipt

          If you are a family based applicant, you can't travel. The original poster sounded like this was the case and there was no L1 or H1 involvement.

            I am on H1 and applied for I-485 last week, I don't have any idea whether it's accepted or not, so I don't have any receipt and I need to travel to Canada this week, do you have any idea whether I need Advance Parole or not? I am a Canadian Citizen.

              Hopefully someone will answer that for you.
              Your best bet is to call USCIS customer service and they will give you the answers you need 1-800-375-5283 ..
              When you call , they will ask you a few questions..where you live,etc status etc but tell them your exact situation.. your visa, the situation etc in order to get the proper advice.

              Just as an FYI, i was just reading on the official site, that on July 30th and after, the price of an travel document is going up to $305 from (190?)
              So if you need one, make sure you submit before the 30th to save yourself the money.

              And sorry to hear about the other person that was hoping to get it earlier, it is definitely the hardest part when it comes to immigration. When your told you cannot travel to your own country (something you have been doing for years) then you start to look at the entire situation.

              I have been waiting like many here for a long time just to get my green card.. I only applied for it because I married an American. (I was here 4 years legally on a tn visa)

              I regret applying for the green card as A)I was fine with the tn visa and B)I am not setting in the US.

              In fact, if I dont get my green card soon.. I am probably going to withdraw my applications, chalk it up as a loss and simply move back. The US is a fantastic country, but with my travelling document expiring in Sept, there is no way I can go another 6 + months without visiting home.



              Anyways, sorry a bit off topic but that is my situation.

                I talked with my Lawyer and she told me that you don't need AP as your application is not accepted and you don't have receipt on hand which is I think quite understandable. I appreciate your help if you have any comment on this.
