  • Help!!! Can I adjust status?

    Need advice!!! I am an illegal immigrant living in the US. My parents brought me in to the U.S. illegally at the age of 6. We were never caught by immigration officers. I am now 25 and a recent graduate with a bachelors degree in business. I am also married to my husband who is a U.S. citizen. We have been married for two years. We want to legalize my status and are now in the process of filling form (I-864)Affidavit of Support. We do not want to send it in because my interview will be in ciudad Juarez and I might be punished for entering the U.S illegally and have to stay in Mexico for 3-10 years.

    My questions is: Is there anyting that can be done to adjust my status so that I don't have to have my interview there? Or, if we proceede with the filling will I be pardoned for entering illegally and return to the US as soon as possible?

    Any advice will help tremendously. Thank you all in advance!

    I think your best bet would be to find an immigration lawyer to take assist you.
    You dont want to take any chances and rely on a discussion board with such a serious issue.

      Definitely get a lawyer in your case. It might be pricey, but they are going to know what to do for you.

        And do not leave the country.....you might not be able to come back, even if you are married to a US citizen. Try to adjust status from within the USA, based on your marriage.

          You can adjust your status.

          Spouses (legal or illegal) of US citizens are allowed to adjust their status (even though they may not have a "status.

          WHY are you thinking about this form alone? You need to file I-485.

          You won't be going out of USA. You'll be applying to "adjust status", that is, from within USA.

          Yes, you'll be applying for AOS, by filing I-485, w/ supporting documents. Good Luck!!
