    Hey all, sorry for my sad first post. but i think I am in trouble.....

    I am on an H1B and I can file my i140 and 485 concurrently now..however i just realized that the 485 requires tax returns for the last 3 years?!?

    Now, in 2006, my company was in a little bit of doldrums and so I was on a little 'leave of absence'..it was only for a short while...maybe 3-4 months, and since then things are perfectly OK, but my 2006 tax return will show my income to be around 30% less. Now, i have pay stubs for every week for during that period...i was not paid fully though...and since then i have mantained my status and even got a salary increase and bonusees...

    Now, I am wondering if some ins agent looking at it thinks i have not maintained my status....and so I am afraid...what must I do....Obviously I canwait for 3 years to get the 2006 year off the record.... but that will take me to 2009...any suggestions from the gurus.

    I am thinking to file the I140 now and wait for the I485 date to be current, but after july, when will it become current again ??!!

    Don't worry

    First of all you don't need 3 years tax returns. My lawyer asked for only last years tax returns. And don't make a mistake of waiting for 485 to be current, it'll be backed up a big time. Tax returns is to prove ability to support yourself. Just submit the tax returns that you have, most likely you will be fine, if you get a RFE you can explain, deal with it at that time.

    Some people in a similar situation create **** tax returns by using Turbo Tax s/w and entering false numbers, they go complete the returns until the last step and take a print out, but never really file it. They submit these print outs as tax returns. USCIS never cross-checks the tax returns with IRS. There are also web-sites that allow you create **** pay stubs and W2 forms for fun/entertainment somethin like noveltypaycheckstubs.com. I recomend you to stay away from such stuff, as it is afterall fraud. A lot of people have used this stuff to get mortgage loans. please don't go that way. You can explain your situation to USCIS when you get RFE. Good Luck.

      Thank you very much for your insight...my only concern is that my 2006 W2 is the lower one...basically 2004 is X, 2005 is X and 2006 is 76%X. Hopefully when you I-485 is being looked at, I can have my 2007 W2 ready and file documentation to prove this.

      Is it possible to amend a I-485 with added W2s or more evidence later??!!
