Hello Friends,
My wife is currently on her L1 visa for emp A. Parallely her I-797 for H1 through Employer B has been approved this year.
She will be filing for her I-485 along with my application before Aug-17 2007.
a) Can she continue working on her L1 in US without getting her H1 Stamped...At this point we are not sure when we would be getting our AP/EAD...I've heard people saying L1 would not be valid since Oct which is when H1 would kick in. Is it ok for her to continue on L1 (while still having unused 797 for H1?)
b) If she happens to leave US (say in Jan 08) while our 485 is being processed... will this have any affect on her H1 stamping in INDIA. Are there any chances of rejection ? (this applies only if by that time we have not yet received EAD/AP)
c) Can she change Visa status from L1 to H1 in midst of 485 being processed? Do we need to submit any document and update USCIS of her change of visa.
