    What are the recommendations on traveling outside the US without receipt notice (after filing for I-485)?

    Priority Date: Feb 2003
    I-485 paper work sent to USCIS on Jun 26, 2007
    I-485 Receipt Notice - waiting for it
    Planned Travel date: Sep 4, 2007

    Hearing that there's no guarantee as to when the receipt notices will be sent.

    You can travel if u have valid H or L visa stamped on ur passport. If not then u have to wait for AP.

      Wait for the I-485 receipt notice. The receipts should get issued in 6-8 weeks. Postpone your trip to september end. Once your check gets deposited by the USCIS, the receipt number will be on the back of the check (online check images). Use that receipt number to track your status online.

        Travel Without Receipt Notice(I-485) but with valid H1B visa

        Hi,
        Currently, I am on the H1B Visa (Valid until Aug 2008) and I recently filed my I-485(08/03/07). The receipt would take atleast 2 months to come. I am visiting my familes in India on Sept10th.

        1. Traveling without Receipt Notice create any problem while entering Port of Entry?

        2. Will I have any problem with my I-485 application filing as I will have a new I-94 form which is different than I-94 forms submitted during the I-485 application

        3. Any chance of Port of Entry denial?

          Go Ahead! with ur travel plans

          You are legally allowed to travel with valid H or L visa...dont worry about any receipt numbers.

          see this (abstract from USCIS web site)

          8 CFR 245.2(a)(4)(ii)(C)

          "The travel outside of the United States by an applicant for adjustment of status who is not under exclusion, deportation, or removal proceeding and who is in lawful H-1 or L-1 status shall not be deemed an abandonment of the application if, upon returning to this country, the alien remains eligible for H or L status, is coming to resume employment with the same employer for whom he or she had previously been authorized to work as an H-1 or L-1 nonimmigrant, and, is in possession of a valid H or L visa (if required) and the original I-797 receipt notice for the application for adjustment of status . . ."

              Valid H1B

              You will probably not be denied at port of entry because of valid H1B but our lawyers said if you leave w/out receipt notice then it could be considered an abandmonent of your I-485 filing and you may have to re-file. That's why I asked the question to see if anyone had that experience before. Good luck!
