  • I-485 I need advice

    I am about to aplly for an ajustment of status and I will really appriciate if someone who knows or have been in a simmular situation can tell me what to expect.
    This is my situation that I am faced with:

    - I married U.S. citizen in 2004 in Canada, we got married in Canada and I am Canadian;

    - We have daughter 2 and half years old she was born in Canada;

    - Myself and our daughter joyned my husbant/father in U.S. in November of 2006;

    - Now we are ready to do all parerwork for my immigration (9 months later) which make us stay here illigally for 3 months, since as a visitor one can stay 6 months legally. I hope that uor daughter will have no problem to get her citizenship.

    And few more questions:

    1. How long does it ussualy takes to get a reply from the immigration office?

    2. When is it better to apply for permition to leave the country while application is pending?

    3. What are the consequences from the above situation?

    dont worry about the overstaying,,,as long as you entered the us legally the worst that can happen is you paying the supplement a fine. go ahead and file your application the time frame is pretty good lately....ny has been one of the longest but now its quick,,,you should get your social and employment card within 90 days of applying....go for it i've had lots of uscis issues as i'm a citizen who filed for my husband
