Hi could someone help with the following question:

Is it true that a person won't get EAD/AP without their 140 being approved?. I have been told by lawyers that Homeland Security has been inconsistent with that rule?

Not True.

Your EAD / AP approval has got nothing to do with your I-140 approval.
The only approval that is dependent on I-140 approval is I-485.

You should be able to get your EAD / AP within 3 ~ 6 months of application based on the backlog in the service center
