  • My Attorney/Employer filed my I-485 while I was in India

    Hi, Here is my situation. I have given all my valid docs for I-485 filing on Jun28 2007. Attorney got it on 29th, but he did not mail them to USCIS as there were rumours for the "I-485 Current" will be reverting back. Attorney/Employer knows that I will on vacation to India for 3 weeks from Jul13 to Aug 5th. Though they know It is unfortunate that they sent my I-485 application on Jul24th while I was in India.
    What would be the consequences to this type of situation? Will USCIS accept my application or they simply deny and will ask me to resubmit it again with the new I-94 and Passport copies? Your input is highly appreciated. -Thanks!

    That is a tough one. You are supposed to be in US while filing I-485. I am not sure what is going to happen.

    Your attorney may be able to give better insight into this.
