  • Doubts concerning AOS

    Hello friends,

I would love to say that people on this website are very helpful and give correct information. i have few doubts regarding my AOS process. i hope u guys have the information that i need.

I came to USA in August 2007 on H1 B visa. I married a US citizen girl in India in july 2007. she is filing me in a day or two. i am submitting I-485, I-765 and I-130 to the chicago post box. i beleive i dont need the I-131 since i can reenter and exit on my H1B visa. here are my queries. please help me out and guide me.

    1. Should i also submit my medical papers I-693 along with the I-485 right away or can i do it a later point of time? the website says send the medical papers along witht he application if u are filing with a USCIS service center whereas i am sending this to the chicago PO box. I am confused!!!!!

    2. Should i go for the advance parole I-131. the website says since u have H1-B, there is no need for I-131.

3.Should i also attach the I-864, affidavit of support along with I-485?

    Please help me out....

I am confused!!!!! Send them along with the I-485. At the same time. Everybody is sending their applications to the Chicago Lockbox so do not worry. If you do not send them, it will delay your application.

    2. Should i go for the advance parole I-131. the website says since u have H1-B, there is no need for I-131. The current filing fee for I-485 ($1,010) includes the fees for EAD and AP already. So, why not?

3.Should i also attach the I-864, affidavit of support along with I-485? Yes, that is VERY important. Do not forget to include it.

    Please help me out....

Still have 2 doubts concerning AOS

      Hi,

Thank you very much for answering my queries. I think i will apply for my AP as well. but i still have some doubts like:

      1. my wife is still a student and she is not employed anywhere. this means she cannot sponsor me. however i think a joint sponsor can sponsor my appication. my questions is:

With the I-485 document, should i send her I-864 form or only the form of the joint sponsor or both. BAsically i cant fill the I-864 form for my wife coz she cant sponsor me.

Both forms, even if her income is $ 0, she is your sponsor and someone else is your co-sponsor... so send both of their forms.
