485 Rejected due to Incorrect Fee for July 2 nd filer @ TSC

I 140 got approved in April 2007

Filed case on July 2 nd @ NSC...got transferred to TSC

I made sure I have followed all those requirements,gathered all those doc and sent package to attorney...Attorney sent my docs to USCIS on July 2nd...

I called USCIS on 9/7/07 day to find abt the status of my case as I have neither received any receipt numbers nor my checks got encashed....and heard this shocking news...not properly filed...


On Aug 24 th, they have decided that they r rejecting my case due to INCORRECT FEE.


I have been waiting for this GC/EAD since 2002 and here is the result..

Are there any one on the same page,,,I hope not but just curious...

I'm sure my attorney wld have reviewed all those docs before he sending USCIS...still result is unexpected...

They said they have returned package which contains all family members docs on 08/24....they said they have sent some notice which talks abt the reasons for rejection...


The online status has following

"On August 24, 2007, we determined that this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was not properly filed, rejected it, and mailed it back to you with all supporting materials along with a notice describing the reasons the case was rejected. The notice will also describe what will need to be done to properly submit the case."

I am hoping it is some kind of mistake or confusion around the old/new fee structure. Based on the wording here, it sounds like they are going to allow me to resubmit the application. But I am not sure if priority dates are going to be an issue.


I got info frm my attorney wid DHL tracking num...

it says that my package got signed by V ANGEL:

my Attorney was saying that we have to wait untill I get that returned packe which includes 485 apps.It's been 22 days since they sent out my package and I haven't yet received it....


WHAT SHLD I DO NOW otherthan waiting for my package?

485 Rejected due to missing 797 doc., but not really missing

Submitted 485 as part of the July bulletin and received reject status on 15thSept2007, with reject remarks as missing i-797 (140status, which has been enclosed already) and to resubmit , My case clearly looks like an overlook by USCIS , please suggest if any one had such issues and how to proceed.

yeah, I had a similar issue. We sent our work in April, but because of a minor fee change, or an error on my money order (I don't remember which), they sent the forms back to us with an I-797C attached. We sent the forms back near the end of July and just got them back a few days ago with another I-797C attached, this time because of the USCIS fee increases.

We're frustrated about it too. I was told by USCIS that if I send proof that I had sent these forms in before, I should be fine. In my case, if I send them back with the original I-797C and copies of post office receipts, I should be fine.

You have an attorney, so I'm sure he'll take care of whatever you need for you. You'd probably need to send in proof that they received it on the second of July, like the tracking info says.

hey i dont understand one thing how did u manage to ask them, about ur case when u neither have the receipt # nor the lien # as i tried and they wont answer. My case was also filed on 2july NSC and have still not recd no receipts as of yet and am worried too. Nor has my cheques been cashed. I called themup too and they siad i have to wait for atleast 90 days before they can answer so how did u inquire i wanna know for my knowledge.

I don't have any numbers, they only give it back to you on the receipt that you'd receive from them accepting your applications. You are still able to call and ask for general advice, however, and the agents will carefully answer your questions with the explicit goal of helping you understand the filing instructions, carefully avoiding answers that fall into the category of legal advice.

I am also in the same situation.
My wife case got rejected and Yesterday my attorney received rejected application.
And we are re-submitting the application today.
What happened to your case?Did you re-submitted your application?
