    Hi.

    I had filed a I-140 EB-2/NIW concurrently with an I-485 in September 2005. My I-140 was approved in May 2006 with 9/29/05 as the PD.

    We were interviewed for AOS (Adjustment of Status) on May 23, 07. The interview process went well and the officer informed us that our fingerprints were outdated and that she would recommend approval of AOS following completion of new sets of fingerprints. She took our I-94 cards from us that day.

    The fingerprinting was completed on June 2nd and we sent the letter to USCIS confirming the fingerprinting. They received them around June 9th.

    In meantime, I had also applied for another I-140 under EB1-EA category. This has also been approved with a PD of 11/29/05.

    Then, there was this “unavailability of visa” crisis.

    During one of our InfoPass based conversations with USCIS, Baltimore, we have been told that our files are otherwise complete and they have been waiting for a visa number for our EB2/NIW I-140 based petition.

    On September 6, our attorney went to Baltimore USCIS on our behalf and met the officer who had interviewed us for adjustment of status. She submitted an interfiling petition with an approved I-140 EB1EA petition to our pending I-485.

    Are these interfiling typically accepted? Does any one have any idea about the approximate time between submission of interfiling petition and approval of adjustment of status? Any further suggestions? Should I take another InfoPass appointment to find out the status?
