  • help for someone on deep trouble

Hello everyone, let's go to the point. In 1998 i entered US illegaly and filed for asylum a year later. My case was denied in 2001 and my lawyer filed appeal. In april of the same year,i married my girlfriend of 2 years and filed with the same lawyer a marriage pettition(I-130) and an adjustment of statut. Both were filed and sent to the immigration services before april,30th. We(my wife and i)waitted about 2 years to find that the I-130 was approved but i could'nt adjust. And i was ordered a deportation on my asylum case.Since then it is been race against time and common sense. We change a lawyer who tried to reopen the case but no luck.....always come the question of why we waitted 2 years to try to reopen that case. All we know we trusted a lawyer who did not represent us the way it should be.We moved once since we filed the appeal, the marriage pettition and the adjustment of status and we sent him a change of address with our new address,we paid him the remainnig of his fees from our new address. But he did not notive us of any outcome until we went to the office of homeland security to find out what's going on.Any thought will be appreciated.

A person who came here illegally can not Adjust Status.

Thanks for your reply.I believe in 2001 the us congress passed a suplement to I-485(I-485i) given a chance to those who came illegaly to adjust their statut under this law and the deadline to do so was april 31,2001.And so we filed under that law.

Read the instructions for that "Exception" then, and come back with questions if you meet the criteria.

I said on my first thread that the same lawyer who was in charge of my asylum case was also in charge of my adjustment base on the marriage under the suplemnet(i-485i) and i believe i met the criteria.Any way you think i did not meet the criteria and my lawyer filed the adjustment....I do not think so.
