  • Rejected I-485 for no reason?

    Hello,

    My wife and kids came here as k3/k4 and i have applied for adjustment of status, send all required documents everything was fine we went to the interview and the only request was the medical exam. We completed the medical and mailed the envelops via certified mail.

    1 month later we get a denial with the reason that we failed to send her the medical exam. The United states postal service reports that they did deliver the documents 3 days before the deadline and PostalService also produced a signature of who accepted the documents.
    I got a letter from the USCIS designated medical examiner stating that we did undergo the exam and that we were on perfect health.

    My question to anyone out there is.
    What should i do just file a motion and/or appeal to reconsider and wait 20 moths to tell them that they screwed up our documents within their establishment?

    get an attorney

    you can fight on your own with uscis, but it's advisable to get an attorney at this point and let him/her handle your case

    you don't any more mess that what you already have

      how much time did they give you to send them the medical exams? waiting until 1 week from the deadline was the problem perhaps?

        we were there august 16 they gave us until September 15.
        I did send the doc in time sep 10 and they did arrive at the location sep 12 i have proof which the postal service provided and in addition who signed for it.

        PraetorianXI i hope your not saying that we should take into account their internal workings. If so that gives them complete power to loose anything they choose to, and clam it never arrived.

        Thank you for your replies this is very frustrating, because i know I'm in right and theres nothing I can do about

          You can try making an infopass (http://infopass.uscis.gov) to your local office and bring the copies of the medical exams and ask what is going on.

          The next step would be filing a Motion to Reopen with a lawyer or file I-485s all over again, this time including the medical examinations.

            please file the motion asap, you may have read some of my replies, I filed a motion for my husband, the other thing is making sure it does not get loss in the archives make monthly inquires if it gets worst make a complaint to the office with evidence on negligence by the office address below:
