    Hi!!

    While filing for my I-140 & I-485 my company lawyer informed me that my company will not extend my H1 once I-485 is applied and EAD is filed ... huh..
    currently i am in my 8th year H1 with EAD on my way. Now I wanted to know as to what can i do to keep my H1 alive and extend it till i receive GC since still i am in concurrent filing of I-140 and I-485. Is there anyway to convince the HR dept. in my company or whosoever looks after immigration matters or should i consult my lawyer again and take their advice. I really don't want to give up on my H1 in this stage of GC.

    P.S My current H1 expires in Nov'08 almost after a year. Even if i get my EAD in the meantime can i still work on H1 till expiration or will i have to start using EAD and convert to EAD status from H1 immediately.

    Can Work..

    Hi,

    I do know that you can work on your H1B till it expires. You do not need to use EAD if you don't have the need.

    In your case you can work on H1 till 2008 when it expires. Hope this helps.
